Terms of Use

1. Agreement and developer

These Terms of Use ("Terms") are an agreement between the user and REPLACE_WITH_LEGAL_ENTITY_NAME, doing business as Haus of Zimmerman ("Haus of Zimmerman," "we," "us," or "our"), concerning The Haus Edit application, beta versions, related reports, and associated support pages.

By downloading, accessing, or using The Haus Edit, the user agrees to these Terms and applicable Apple terms. If the app is distributed through the Apple App Store and no custom end-user license agreement is supplied in App Store Connect, Apple's Standard Licensed Application End User License Agreement applies to the app license. These Terms are intended to supplement, not conflict with, applicable Apple terms.

Apple's Standard EULA is available at Apple's Licensed Application End User License Agreement.

2. Eligibility

The user must be legally able to enter this agreement. A person using the app on behalf of a company or other organization represents that they have authority to bind that organization to these Terms.

3. Beta software

Beta versions are provided for testing and evaluation. Features may change, contain defects, produce incomplete or inaccurate results, reset, become unavailable, or differ from a future public release. The user should maintain independent records of important measurements, products, decisions, and reports.

4. Limited license and acceptable use

Subject to these Terms and applicable Apple usage rules, Haus of Zimmerman grants the user a limited, non-exclusive, non-transferable, revocable license to use The Haus Edit on Apple-branded products the user owns or controls, including use permitted through Family Sharing or similar Apple features when applicable.

The user may not:

• Copy, sell, rent, sublicense, distribute, or commercially exploit the app except as expressly permitted.
• Reverse engineer, decompile, disassemble, bypass, probe, interfere with, or attempt unauthorized access to the app, except where applicable law expressly permits it.
• Use the app to violate law, intellectual-property rights, privacy rights, contracts, leases, codes, permits, association rules, or manufacturer instructions.
• Upload, enter, share, or transmit unlawful, infringing, malicious, or unauthorized material.
• Misrepresent app outputs as architectural, engineering, surveying, code, accessibility, safety, or other professional certification.

5. Preliminary room-planning tool only

The Haus Edit supports room scanning, manual measurements, scan review, furniture decisions, proposed products, 2D layouts, rotatable 3D layouts, project standards, clash analysis, layout options, and PDF reports. These functions provide preliminary planning information only.

The app does not provide architectural, engineering, surveying, permitting, construction, accessibility, code-compliance, life-safety, legal, financial, or other licensed professional services. Use of the app does not create a designer-client, architect-client, engineer-client, contractor-client, fiduciary, or other professional relationship with Haus of Zimmerman.

Users must independently verify all measurements, architecture, clearances, product dimensions, product availability, pricing, placement, circulation, structural conditions, utilities, egress, accessibility, codes, permits, manufacturer requirements, and actual site conditions before purchasing, fabricating, constructing, installing, or relying on any output.

6. User information and project content

The user is responsible for the accuracy, rights, and legality of all project information entered into or shared from the app. The user retains ownership of their original project information, subject to the licenses necessary for the app to process that information on the device and to perform actions the user requests.

The user should not enter or share alarm codes, door codes, precise security-system details, confidential client information, or other sensitive information that is unnecessary for room planning.

7. Local storage and risk of data loss

During the current beta, project information is stored locally on the user's device. The user is responsible for protecting the device and maintaining independent copies of important information. Deleting a project, deleting the app, device failure, storage changes, software errors, operating-system changes, or backup behavior may cause loss of project information. Haus of Zimmerman does not guarantee recovery of locally stored information.

8. Products, links, and third-party services

Product names, links, prices, dimensions, and availability may be supplied by the user or a third party and may be incomplete, outdated, or inaccurate. A link or product entry does not guarantee availability, compatibility, quality, safety, delivery, or suitability.

Third-party websites, retailers, Apple services, email providers, and sharing destinations are governed by their own terms. The user must comply with applicable third-party terms when using the app.

9. PDF reports and sharing

Reports summarize information and analysis available in the app at the time of export. The user must review reports for accuracy before sharing or relying on them. Reports are not construction documents, permit sets, professional certifications, purchase approvals, or installation instructions.

10. Intellectual property

The Haus Edit name, branding, software, interface, original content, project-standard structure, analysis methods, report design, and other proprietary materials are owned by Haus of Zimmerman or its licensors and are protected by applicable intellectual-property law. Except for the limited license above, no ownership rights are transferred.

11. Feedback

Users may voluntarily submit beta feedback, ideas, or suggestions. To the extent permitted by law, the user grants Haus of Zimmerman a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, and incorporate that feedback to evaluate, improve, market, and commercialize the app without compensation or attribution.

12. Maintenance and support

Haus of Zimmerman, not Apple, is responsible for any maintenance and support it agrees or is legally required to provide for The Haus Edit. Apple has no obligation to provide maintenance or support for the app. Beta support may be limited, delayed, changed, or discontinued.

13. Disclaimer of warranties

To the fullest extent permitted by law, The Haus Edit, beta builds, reports, content, and services are provided "as is" and "as available." Haus of Zimmerman disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, reliability, and error-free operation, except where a warranty cannot lawfully be disclaimed.

Haus of Zimmerman does not warrant that scans, measurements, layouts, 3D views, standards, clash analysis, product information, or reports are complete, accurate, current, safe, code-compliant, or suitable for a particular project.

14. Limitation of liability

To the fullest extent permitted by law, Haus of Zimmerman and its owners, personnel, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost data, profits, savings, business, or opportunities; project delays; purchasing decisions; property damage; personal injury; construction or installation outcomes; or reliance on app outputs.

Any limitation or exclusion applies only to the extent permitted by applicable law. Some jurisdictions do not allow certain limitations.

15. Apple-related acknowledgements

These Terms are between the user and Haus of Zimmerman, not Apple. Haus of Zimmerman, not Apple, is responsible for The Haus Edit and its content, for addressing product claims to the extent required by law, and for investigating and resolving third-party intellectual-property claims concerning the app.

Where Apple's applicable license terms provide a refund remedy for an app that fails to conform to an applicable warranty, the user may notify Apple as provided in those terms. Apple has no other warranty obligation for The Haus Edit to the maximum extent permitted by law.

Apple and its subsidiaries are third-party beneficiaries of these Apple-related provisions and may enforce them against the user where applicable.

16. Legal compliance

The user represents that they are not located in a country subject to a United States government embargo or designated by the United States government as supporting terrorism, and that they are not listed on a United States government prohibited- or restricted-party list. The user must comply with applicable export-control and sanctions laws.

17. Suspension, termination, and changes

We may suspend or terminate access for misuse, legal or security reasons, discontinued beta testing, or violation of these Terms. The app and these Terms may change. Material updates will be reflected by a revised effective date. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

18. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Subject to attorney review and applicable law, disputes will be brought in REPLACE_WITH_VENUE.
